Texas Payment of Wages Act
The Fair Labor Standards Act (FLSA) and Texas labor laws are intended to protect employees from unfair labor practices. The Texas Payment of Wages Act (Texas Payday Law) governs the time and manner of the payment of wages. It is specifically intended to deter employers from unlawfully withholding wages from employees. The Payday Law applies to employers of one or more employees.
"Wages" include any form of compensation for work performed by an employee, including:
- Sick leave and personal time pay
- Holiday and vacation pay
- Severance pay
All employees besides administrators, executives or other comparable professionals are required to be paid at least twice a month for equal pay periods on designated paydays. Commissions and bonuses must be paid within a reasonable time as agreed by the employer and employee.
Any employee not paid in accordance with Texas payday law may file a wage claim with the Texas Workforce Commission. They must do so before taking legal action with an attorney for unpaid wages.
